SPRINGFIELD, Ill. (WICS/WRSP) — The Illinois Supreme Court announced that a new rule regarding practice and procedure in eviction cases has been approved.
Rule 139 requires that eviction complaints include a copy of the written eviction notice or demand, as well as, when applicable, relevant portions of the lease.
The rule intends to define the law, practices, and procedures in eviction courts by requiring that demands, termination notices, proof of service of the demands and notices, and relevant portions of leases be attached.
Additionally, Rule 139 allows for the attachment of an affidavit by the plaintiff using a standardized form instead of an eviction notice or demand, as well as the use of an affidavit if the plaintiff does not have the lease or if there is no written lease.
It was first proposed by the Circuit Court of Cook County Pro Se Advisory Committee to the Supreme Court Commission on Access to Justice Commission.
Rule 139 is effective immediately.
